Terms of Use

You must be at least 16 years old, or the age of digital consent where you live, to use this site or contact us through it. If you use the site for an organisation you confirm you may bind it to these terms. If you do not accept these terms, do not use the site.

You may read, link to, and share this site. Do not disrupt it, probe it for vulnerabilities without permission, scrape it at a volume that degrades service, or use our forms to send unlawful, infringing, or abusive content. We may withdraw access if you do.

Status labels such as Building, Beta, and Live describe our current intent, not a commitment to ship, and can change without notice. Each product is governed by its own terms and privacy policy.

Marketgence apps are licensed, not sold. Unless an app ships its own end user licence agreement, Apple’s standard Licensed Application End User Licence Agreement applies. In that case: the licence is a non-transferable licence to use the app on Apple-branded devices you own or control; Marketgence Technologies LLC, not Apple, is solely responsible for the app, its content, maintenance, and support; Apple has no obligation to furnish support; Apple and its subsidiaries are third-party beneficiaries of the licence and may enforce it against you; and any claim about the app, including product liability, legal compliance, or intellectual property claims, is our responsibility rather than Apple’s. Refund requests for App Store purchases are handled by Apple.

The Marketgence name, product line names, marks, site design, and copy are owned by Marketgence Technologies LLC. Nothing here grants a licence to use them.

The site is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. To the extent permitted by law, we are not liable for indirect, incidental, or consequential loss arising from use of this site. Nothing in these terms limits rights that cannot be limited under the law that applies to you, including mandatory consumer rights in the EEA and UK.

Our Privacy Policy explains how we handle personal data. These terms are governed by the laws of the State of Wyoming, United States, without displacing mandatory consumer protections of your country of residence.

You keep ownership of anything you submit through our forms. You grant us a limited licence to read, store, and act on it so we can reply to you or run the waitlist, and you confirm you have the right to send it. Do not send confidential, regulated, or sensitive personal information through these forms. Unsolicited product ideas or feature suggestions may be used without obligation, compensation, or confidentiality.

Beta and pre-release products may be incomplete, change, or be withdrawn, and may not preserve data. Nothing on this site or in our products is legal, financial, medical, tax, or other professional advice. Where a product generates output using artificial intelligence, that output can be inaccurate and must be reviewed by you before you rely on it; you remain responsible for decisions you make from it.

We link to sites and stores we do not control, including the App Store, Google Play, and code repositories. We do not endorse them and are not responsible for their content, terms, or availability. Purchases and downloads made there are governed by the operator’s terms.

If you believe material on this site infringes your copyright, email hello@marketgence.com with the work concerned, the URL, your contact details, a statement of good-faith belief, and a statement made under penalty of perjury that you are authorised to act. We remove or disable infringing material and terminate repeat infringers.

You agree to indemnify Marketgence Technologies LLC against claims and costs arising from your unlawful use of the site or breach of these terms, to the extent permitted by law. You confirm you are not located in, and will not use our products from, a country or by a person subject to United States embargoes or restricted-party sanctions, and that you will comply with applicable export control laws.

Before starting formal proceedings, contact us and allow 30 days to resolve the matter informally. Disputes not resolved that way are subject to the courts of the State of Wyoming, United States, except where the law of your country of residence gives you the right to bring proceedings locally. We may suspend or end access to the site at any time. We may change these terms; the date above shows the current version and continued use after a change means you accept it. If a provision is held unenforceable the rest stays in force. These terms, with the Privacy Policy, form the entire agreement about this site. You may not assign them; we may assign them in a merger or sale of the business.

We aim to meet WCAG 2.1 AA on this site. If any part of it is difficult to use with assistive technology, email us and we will help and fix the problem.
